Frankenstein and Copyright: 5 Things You Should Know. The first edition of Frankenstein, or The Modern Prometheus, was published in 1818, two hundred years ago.
Originally offered to the public as an anonymous work, Frankenstein was both the apogee of the gothic horror novel and the birth of the science fiction genre. The public did not learn until years later that this masterpiece had been penned by Mary Wollstonecraft Shelley. Shelley had written the work on a rainy day in 1816, when she was only nineteen. Incredibly, twenty-year-old John Polidori was simultaneously inventing the vampire genre just down the hall in the same Geneva villa. The actual publication date of the first edition was January 1, 1818, but the Halloween season is as good a time as any to commemorate the two-hundredth anniversary of Frankenstein and its relationship to copyright law.

As with any word, several meanings can be attached to it. Perhaps it is best to first discuss the more general meaning of the term and then explore the more specific meanings as we develop an analysis of open education. The word open, broadly speaking, means to be flexible, free, and welcoming, and relative to closed, it means non-prejudiced, non-restricted, and unfettered. On the Commons is co-sponsor of a Commons Festival at Augsburg College in Minneapolis October 7-8 where she will speak. (See accompanying sidebar for details.) Creative Commons license upheld by court. A court in the Netherlands has ruled that a Creative Commons license is binding, in a case brought against a Dutch gossip magazine by an ex-MTV star.
This is one of the first times that the license--which offers more flexibility than traditional copyright licenses--has been tested in a court of law, according to legal Web site Groklaw. "The Creative Commons licenses are quite new, so there has been very little in the way of case law so far, so this is a significant development," Groklaw reported. Former MTV VJ Adam Curry sued Weekend, a Dutch gossip magazine, for copyright infringement after the magazine published photos of Curry's daughter without his authorization. The court ruled that Weekend must not use Curry's pictures again or it would face fines of 1,000 euros (about $1,200) for each photo used without permission, Curry said in his blog.

The latter, referred to in this paper as expansive definitions of OEP, encompass open content but also allow for multiple entry points to, and avenues of, openness. Scholarly communications shouldn’t just be open, but non-profit too. Much of the rhetoric around the future of scholarly communication hinges on the “open” label.
In light of Elsevier’s recent acquisition of bepress and the announcement that, owing to high fees, an established mathematics journal’s editorial team will split from its publisher to start an open access alternative, Jefferson Pooley argues that the scholarly communication ecosystem should aim not only to be open but non-profit too. The profit motive is fundamentally misaligned with core values of academic life, potentially corroding ideals like unfettered inquiry, knowledge-sharing, and cooperative progress. There are obstacles to forging a non-profit alternative, from sustainable funding to entrenched cynicism, but such a goal is worthy and within reach.
