O consórcio Norte Energia, responsável pela obra da usina de Belo Monte, informou que ainda não foi notificado da decisão do TRF e que só vai se manifestar sobre o assunto na Justiça. Cabe recurso ao Supremo Tribunal Federal (STF). O consórcio responsável pela obra deve ser notificado da decisão de paralisação das obras até quinta (16), segundo o TRF. Em novembro do ano passado, o tribunal havia negado pedido do Ministério Público Federal para anular o decreto legislativo 788, que autorizou a instalação da usina em 2005. While the project has been suspended previously on numerous occasions, and those suspensions overturned on political grounds, this latest decision could have some legs. The decision breaks down in the following way: The federal judge ruled that no consultations were held with indigenous people prior to Congress issuing Decree 788 in 2005, which effectively approved the Belo Monte Dam. Article 231 of the Brazilian Constitution requires consultations to be held directly by the Congress prior to approval. In a press conference given today late in Brasil, Souza Prudente stated that "only in a dictatorial regime does a government approve a project before holding consultations. A group of judges from Brazil's Regional Federal Tribunal (TRF1) upheld an earlier decision that declared the Brazilian Congress's authorization of the project in 2005 to be illegal. Similar conflicts over violations of indigenous rights by dam projects are emerging elsewhere in the Brazilian Amazon. Agora os povos indígenas afetados terão que ser ouvidos pelo Congresso e as obras ficam paralisadas até que a consulta seja realizada.
