The Harry Potter Lexicon website was considered to be fair use (and was used extensively by Warner Bros., Electronic Arts, Scholastic, and even Rowling herself during the creation of the books, films, and games) while it includes plenty of direct quotes from Rowling's material. Rowling even blessed the website with a "Fan Site Award" in 2004, so she and other entities were obviously aware of the site's content. That website is "fixed in a tangible medium of expression" and as such is copyrighted automatically. There is no difference between publication in a print medium and publication in an online medium: "publishing is publishing" in that it satisfies the requirements for copyright. Many, many fan websites use copyrighted material extensively, and most have not asked for permission to use that material.

OTW Produces Fan Fiction Studies Reader

The brainchild of Transformative Works and Cultures editors Karen Hellekson and Kristina Busse, the reader is a reprint collection of many key works in the field of fan studies. The Reader is intended for classroom use, but it will also be of interest to people in the field of fan studies. All royalties for The Fan Fiction Studies Reader will go to the OTW. The OTW supported the project by paying fees for the essays' reprint rights. (In the case of many such anthologies, these payments are provided by the academic institutions that employ the editors.) The essays, which are organized into four thematic sections, address fan-created works as literary artifacts; the relationship between fandom, identity, and feminism; fandom and affect; and the role of creativity and performance in fan activities.
