"Active" neglect refers to behavior that is willful - that is, the caregiver intentionally withholds care or necessities. The plaintiff alleged that the defendants’ negligence, specifically relating to the failure to timely diagnose and treat hyperglycemia, allowed the decedent’s hyperglycemia to progress untreated, ultimately causing the decedent to lapse into a diabetic coma from which she did not recover.
