Freedom of Expression. F-ck the Draft This is not a type-o, nor is it something which the author of this chapter has somehow managed to slip slyly past the editors. While I hope that this does not offend, I would not be surprised if some readers were indeed shocked and perhaps even offended. The editors, of course, could have chosen to leave it out, this being a private forum. It is important, however, to note that in 1971 the Supreme Court held that a state could not convict an individual for “offensive conduct” based solely on the content of his speech; the First Amendment protected Paul Robert Cohen’s right to wear a jacket to court on which the words “F-ck the Draft” were written.

Earlier this month, agencies released their Open Government Plans – roadmaps for creating agencies that are responsive and engaging to the public, as well as transparent with their work and their information.

As part of a broad coalition of open government advocates, convened by OpenTheGovernment.org, CDT has been working to independently evaluate the Open Government Plans against the Open Government Directive. While openness advocates we hope to see a number of gains that are not addressed in the Directive, we decided it would be best to measure government plans according to the letter of the directive that described the plans. We did award bonus points for those agencies that chose to reach beyond merely meeting the letter of the directive – such as creating multiple points of engagement for ongoing projects, or actively facilitating and moderating discussion around their plan.
