Pursuant to ICANN’s Uniform Domain Name Dispute Resolution Policy, in order to take a domain away from a registrant via arbitration, the Complainant must prove that: (1) the domain name registered by Respondent is identical or confusingly similar to a trademark or service mark in which Complainant has rights; and (2) Respondent has no rights or legitimate interests in respect of the domain name; and (3) the domain name has been registered and is being used in bad faith. In this case, the panel found that while LadyGaga.org and Lady Gara are certainly identical or confusingly similar, Lady Gaga has failed to show that the fan had no legitimate interests in the domain.

When I typed in littlemonsters.com on google.com (Lady Gaga's new social network. - it said that firefox was not supported and the references said backplane - the company designing it. I was able to sign up (well the attempt where I didnt' want to put in my real birthdate failed. (Just for privacy purposes. But don't put in a year before the age of 13 like I did, because it will bounce you out) I did sign in with my twitter account. But it wiped out my user name that I had for the account - my 500 words of about me (after spending quite a few minutes) and my interests.
