For the uninitiated, this is a picture of an Indonesian macaque monkey. “What’s the big deal,” you may be asking yourself, “it’s just a National Geographic looking picture of a monkey.” The big deal, friend, is that the monkey itself took those photos. David Slater, a professional photographer, was in Indonesia photographing the local wildlife when a macaque monkey decided to take his camera. So then, what about copyright? 503.03(a) Works-not originated by a human author.In order to be entitled to copyright registration, a work must be the product of human authorship. One might argue that but-for the photographer’s participation, these photographs would not exist, and therefore this is the product of human authorship.

Just as the monkey photography story was dying down, a new twist emerges: on Monday tech blog TechDirt received an email from Caters News, the agency representing wildlife photographer David Slater, whose camera was hijacked by a monkey and used to shoot a number of self-portraits. The email requested that the blog remove the images: I have noticed you have used David Slater’s images on your website. However we are representing David Slater and syndicating these images on his behalf. [...] These images are being used without David’s or our permission, therefore can I ask you remove these images from your site immediately. Techdirt’s original post was focused on whether or not Slater owned the copyright to photographs taken by a monkey.
