ACTA heeft de status van plurilateraal verdrag , als gevolg waarvan de deelnemende partijen minder ruimte hebben om individuele voorbehouden te maken dan bij een multilateraal verdrag het geval zou zijn.

The French HADOPI law or Creation and Internet law ( French : Haute Autorité pour la diffusion des œuvres et la protection des droits sur internet , [ 1 ] "law promoting the distribution and protection of creative works on the internet") was introduced during 2009, providing what is known as a graduated response as a means to encourage compliance with copyright laws . HADOPI is the acronym of the government agency created to administer it. [ edit ] Legislative passage Despite strong backing from President Nicolas Sarkozy , the bill was rejected by the French National Assembly on 9 April 2009. [ 2 ] [ 3 ] [ 4 ] The French government asked for reconsideration of the bill by the French National Assembly and it was adopted on 12 May 2009 by the assembly, [ 5 ] and on 13 May 2009 by the French Senate . Debate included accusations of dubious tactics made against the promoters of the bill.
As a part of France's three strikes law, the organization in charge of implementing the program, Hadopi (which, we should remind you, was caught infringing itself in using a font it did not license for its logo), has been tasked with figuring out a way to actually block people from the internet, or to stop them from using certain file sharing programs. While there were public consultations on how to do this, the actual technical spec was supposed to have been kept secret. Not surprisingly, that didn't last very long. Copyright is a legal concept, enacted by most governments, giving the creator of an original work exclusive rights to it, usually for a limited time. Generally, it is "the right to copy", but also gives the copyright holder the right to be credited for the work, to determine who may adapt the work to other forms, who may perform the work, who may financially benefit from it, and other related rights . It is a form of intellectual property (like the patent , the trademark , and the trade secret ) applicable to any expressible form of an idea or information that is substantive and discrete. [ clarification needed ] [ 1 ] Copyright initially was conceived as a way for government to restrict printing; the contemporary intent of copyright is to promote the creation of new works by giving authors control of and profit from them.

Ownership of property may be private, collective, or common and the property may be objects , land/real estate , or intellectual property . Determining ownership in law involves determining who has certain rights and duties over the property. These rights and duties, sometimes called a 'bundle of rights', can be separated and held by different parties. The question of ownership reaches back to the ancient philosophers, Plato and Aristotle, who held different opinions on the subject. Plato (428/427BC-348/347BC) thought private property created divisive inequalities, while Aristotle (384BC-322BC) thought private property enabled people to receive the full benefit of their labor. Private property can circumvent what is now referred to as the “ tragedy of the commons ” problem, where people tend to degrade common property more than they do private property.

Het heeft even geduurd, maar de onderhandelaars van het anti-piraterijverdrag ACTA zijn eindelijk gezwicht voor de toenemende roep om transparantie. Na ruim 2 jaar in het geheim te hebben onderhandeld, wordt de meest recente conceptversie van het ACTA-verdrag aanstaande woensdag officieel openbaar gemaakt. In Zwitserland is vandaag een nieuwe onderhandelingsronde van het veelbesproken en -bekritiseerde ACTA-verdrag gestart. Onlangs lekte een intern EU-document met het standpunt van de EU-lidstaten uit. Hieruit blijkt dat de EU-ministers mogelijk voorstander zijn van de handhaving van auteursrecht ‘in de huiskamer’. Er staat dus veel op het spel deze ronde. Tot 15 augustus kunnen belanghebbenden (bedrijven zoals telecomoperators en internetproviders) en particulieren hun mening geven, openbaar of privé als dat gewenst is. De Anti-Counterfeiting Trade Agreement (ACTA) is een initiatief van Japan en de VS, genomen in 2007. Het idee hierachter is, tezamen met andere landen, te komen tot een standaard op het gebied van handhaving van intellectuele eigendomsrechten teneinde namaak en piraterij effectief te bestrijden. Behalve Japan en de VS nemen Australië, Canada, de EU en de lidstaten, Marokko, Mexico, Nieuw-Zeeland, Singapore, Zuid-Korea en Zwitserland deel aan deze besprekingen. LUCERNE, SWITZERLAND – There was progress during the ninth round of negotiations for the Anti-Counterfeiting Trade Agreement (ACTA) this week in Lucerne, negotiators said over the last day, and in their final press communiqué they made promises that “ACTA will not interfere with a signatory’s ability to respect fundamental rights and liberties,” it would be consistent with World Trade Organization agreements and certainly “not hinder the cross-border transit of legitimate generic medicine.” But negotiators could not agree to allow the interested public or experts to check how these promises would be phrased, as no new draft ACTA text was released at the meeting’s conclusion yesterday.
