Hit & Run : Reason Magazine

Washington, D.C.— The Supreme Court heard oral argument today on Section 3 of the 1996 Defense of Marriage Act, which forbids the federal government from recognizing state-level same-sex marriages. Judging by what I saw in the courtroom this morning, DOMA could be in serious trouble. “The question is whether or not the Federal government, under our federalism scheme, has the authority to regulate marriage,” declared Justice Anthony Kennedy, who repeatedly suggested that he saw DOMA as an unconstitutional federal intrusion on “the essence of the State police power.” Notably, at least one member of the Court’s liberal wing appeared to share Kennedy’s worries about DOMA and federalism. “What gives the federal government the right to be concerned at all at what the definition of marriage is?” asked Justice Sonia Sotomayor.

The Corner

Rand Paul, Ted Cruz and Mike Lee — the Senate’s rabble-rousing GOP triumvirate – seek nothing less than to fundamentally transform the debate over gun control. As has been reported , they will likely filibuster when Harry Reid brings his gun-control legislation up for a vote. In doing so, according to sources, they hope to effect a dramatic shift in public opinion, akin to one that followed Paul’s 13-hour filibuster earlier this month over President Obama’s drone policy. Their approach is carefully orchestrated, and they are operating on the premise that taking a principled constitutional stand with a little dramatic flair will rally people to their cause. http://www.nationalreview.com/corner

http://www.amconmag.com/larison/ So Jackson Diehl learned nothing from the Iraq war: The problem here is not that advocates of the Iraq invasion have failed to learn its lessons. It is that opponents of that war, starting with Obama, have learned the wrong ones. One lesson from Iraq that many war opponents have learned is that the U.S. shouldn’t be waging unnecessary wars that serve no discernible U.S. interest. That isn’t the wrong lesson to learn. It’s one that Diehl simply ignores, which is probably why he never really addresses how it would serve U.S. interests to go to war in Syria.
