Bibliothèques, musées : exemples de bonnes pratiques en matière de diffusion du domaine public
J’ai reçu ces derniers temps plusieurs demandes de conseil concernant la manière de rédiger les conditions d’utilisation d’une bibliothèque numérique de manière à respecter l’intégrité du domaine public en cas de diffusion d’oeuvres numérisées. J’ai proposé une série de suggestions en vue d’introduire une loi pour le domaine public en France, mais il n’est bien entendu par nécessaire d’attendre qu’une telle réforme soit conduite pour agir au niveau de chaque établissement culturel, afin de protéger le domaine public et de favoriser la réutilisation des oeuvres. C’est même sans doute la chose la plus utile à faire dans l’immédiat, afin de préparer le terrain, si un jour une telle loi venait à être discutée. Beaucoup de professionnels ont néanmoins le sentiment que ces questions juridiques sont très complexes et ne savent pas quelles types de conditions d’utilisation adopter pour diffuser les contenus qu’ils proposent à leurs publics via leur site internet en respectant le domaine public.

Le 20 février 2012, l’association Kleio des étudiants en histoire de l’université Paris Ouest Nanterre La Défense organisait une rencontre intitulée « Wikipédia, un outil pour l’historien ? », en présence de Rémi Mathis en tant que président de Wikimedia France (et conservateur au département des Estampes à la Bibliothèque nationale de France) et de deux représentants de l’université, Vincent Demont, maître de conférences et Benjamin Quenu, ATER. Rémi Mathis a d’abord présenté dans les grandes lignes ce qu’est Wikipédia, avant de parler plus précisément du traitement de l’histoire par l’encyclopédie collaborative et de ses usages possibles dans ce domaine. Après cette présentation, Vincent Demont et Benjamin Quenu ont présenté leur vision de Wikipédia, à la fois dans le cadre de leur mission d’enseignement que dans celle de recherche, et au travers de celle-ci, les intérêts qu’ils lui reconnaissent et les défauts qu’ils lui reprochent.
