Ce sont les sociétaires des mutuelles d'assurances françaises, au statut bien particulier : à la fois assurés et assureurs, ils sont l'expression directe de leur société d'assurances et participent, de près ou de loin, à la vie de « leur » mutuelle. Les mutuelles d'assurances n'ont en effet ni capital social ni actionnaire à rémunérer. Un sociétaire n'est donc pas un simple client dans l'organisation mutualiste. This confounds the constitutional vision of the founding fathers through a perversion of the notion of free speech. Such environments reinforce preexisting viewpoints, undermining the constructive dialogue that promotes progress in democracies. Speaking on September 17—Constitution Day—Sunstein (who is bound for Washington; see Brevia, page 51) said the founders made only one “truly original contribution” to constitutional thought. Their predecessors, influenced by Montesquieu, thought that successful self-government required everyone to be alike. Protection of free speech is one element allowing Hamilton’s “jarring of opinions” to succeed.

The same tool that affords tremendous power to the grassroots, the broad citizenry, the cacaphony of competing "factions" necessary for healthy democracy, also affords tremendous power to the elites who already have wealth and power.
