Professor Cover states that, since the data was shared with a third party, in this case an internet service provider or cellular service provider, Americans no longer have a reasonable expectation of privacy if the third party chooses to share that information. However, Professor Cover says that tech giants such as Yahoo, Google, and Facebook are probably not the best defenders of Americans’ right to privacy. He further argues that these companies should be compelled to inform their customers if the NSA or another agency comes looking for data so individual citizens can defend their Fourth Amendment rights.
