De aanklacht is ingediend omdat de Duitse privacywetgeving stelt dat individuen toestemming moeten geven voordat persoonlijke data opgeslagen wordt. In het geval van Facebook zou data van niet-leden, die dus ook geen toestemming hebben gegeven, op het sociaal netwerk te vinden zijn. "We beschouwen het opslaan van data van externe partijen, in deze context, als in strijd met privacywetten", meldt privacytoezichthouder Johannes Caspar in een door persbureau AFP geciteerde verklaring.

Facebook's iPhone app does ask you to press a button before using it. And agree to something. But what, precisely? Facebook employees know better than most the value of privacy . This past summer Facebook relocated from University Avenue in Palo Alto, CA — where several buildings fan out along the downtown strip — to a new central office in Stanford Research Park. A good friend and two-year veteran of Facebook invited me to check out the new space. When I arrived, a security guard handed me a non-disclosure contract to fill out, a requirement to enter the building. “Just making sure you’re not a Twitter spy,” he said.
