Why is it important? Section A has shown how the rights of children in conflict with the law relating to diversion and alternatives have been enshrined in international human rights instruments. This fact alone is enough reason to promote diversion and alternatives in the reform of justice for children in conflict with the law. In addition to this, however, there are many other reasons why diversion and alternatives are important. This section outlines some key principles of child development and child psychology - an understanding of which has led to the development of the afore-mentioned rights in the first place.

The fact that children in conflict with the law are in a special stage of development has two major ramifications for the criminal justice system: 1. Should they be there in the first place? (prevention, minimum age of criminal responsibility, decriminalisation of status offences and exploitation, and diversion); 2. Back to top 1a. 1b. 1c. 1d. 2a. 2b. 2c. 2d. Philippines - Home page. Children in the Philippines can be arrested and detained like adults from the age of nine years old. The Council for the Welfare of Children reported that from 1995 to 2000, 52,756 children have been in conflict with the law. Many of these cases involved the detention of minors, often in the same cells as adult offenders. Since 2003, over 26,000 children have been provided legal assistance by the Public Attorney's Office.

More than half of the crimes for which minors are charged are not serious offenses. These include petty theft, sniffing of glue or solvents, vagrancy and violation of curfew hours. Many cases involving children are not reviewed immediately. The UN Committee on the Rights of the Child expressed its concern about the Philippine government administers juvenile justice and the incompatibility of the existing justice system with the principles and provisions of the Convention and other international standards relating to juvenile justice.

Child development & psychology • Introduction • 1. Should children be in the criminal justice system in the first place? • 2. If children do need to be in the criminal justice system, how does their developmental status impact on how they should be treated within the system? The CRC Preamble reminds us that “in the Universal Declaration of Human Rights, the United Nations has proclaimed that childhood is entitled to special care and assistance” and “as indicated in the Declaration of the Rights of the Child, ‘the child, by reason of his physical and mental immaturity, needs special safeguards and care, including appropriate legal protection, before as well as after birth.’”

Child Rights Information Network - Resources - This publication is intended primarily for a field-based practitioner working to improve the system for the administration of juvenile justice in any country.

The purpose of thepublication is to provide practitioners with concrete guidance on developing effectiveprogrammes in the field of juvenile justice. This publication examines and documents models of good practice from Save the Children's expertise in juvenile justice work and includes examples of good practice in juvenile justice work by other agencies. The publication has been developed field staff and others (both inside and outside of Save the Children UK) who are interested and involved in juvenile justice work. In order to bring about change to juvenile justice systems, practitioners must first have an understanding of the overall aims and objectives of the juvenile justice system in their country, as well as of the international framework for the administration of juvenile justice.
