Avoiding litigation: IP risk assessment |Entrepreneur's Toolkit - MaRS. For the purpose of this article, intellectual property (IP) is defined as original creative work manifested in a tangible form that can be legally protected. IP includes patents, trademarks, copyright and confidential information. All companies create IP, whether they are aware of it or not.

This is not to say that all companies retain or even protect their IP. When starting a new business, make certain to examine what types of IP your company will use, rely on and even create. This will enable you to assess your risk of intentional and unintentional infringement and gauge the likelihood of detection and resulting litigation. Due to stretched finances, intentional infringement commonly occurs at the start-up stage. New ventures are typically starved for cash and cannot afford proper research, opinions, licenses and IP applications (patent and trademark). In May, Professor Ian Hargreaves delivered his report, "Digital Opportunity: an Independent Review of IP and Growth". Chapter 7 of that report dealt with designs. Professor Hargreaves concluded that design had a "very important contribution to make to growth". But he found that there was a lack of evidence on how well the design IP framework operated to support growth and innovation, and on how best to optimise it to best meet the needs of business. In response we undertook to publish by the end of 2011 our assessment (2.74Mb) of whether there was a need to simplify the design IP system. So as to have evidence to inform our assessment, we launched a "Call for Evidence" and survey of business.

This document pulls together the findings of the research published at the joint Design Council / IPO Designs Workshop, giving a summary of the current state of our research and the need for more. IP Strategy, Due Diligence and Risk Assessment. Competitive Patent Assessment Reports | Patent Analysis Report. Competitive IP Assessment Reports build upon IPVision’s initial review of a company’s IP portfolio to provide an assessment of the key players and patents relevant to the company. Questions answered include: Who are the established competitors in the space? Do they have strong portfolios in this area and is the space “crowded? Reports generally focus upon both known commercial competitors and those organizations who hold (or are developing) significant IP positions that may not be commercially active. Typical report delivery is within 3-4 business days of request. This report is most appropriate for base portfolios smaller than 200 patents.

Uses: Competitive IP Assessments expand awareness of the patent position of a company and potential risks and opportunities that it may face. 12-21. The tool can be run either as a pre-assessment or in full assessment mode. The pre-assessment is 5 questions designed to start you thinking. The full assessment is 10 categories, 62 questions that go in to greater detail. Important note: this is an awareness tool, not an IP evaluation tool.

Intellectual Property Assessment: Fowler White Boggs, Florida Law Firm. What is an Intellectual Property Assessment? An Intellectual Property Assessment (“IPA”) is a necessary step in making the most of an enterprise’s intangible assets, such as know-how, trade secrets, brands, works of authorship and inventions. An IPA determines what intellectual property is owned, whether the intellectual property is properly protected, and how the enterprise currently manages its intellectual property and other intangible assets.

Why is an Intellectual Property Assessment needed? There are many reasons to conduct an IPA. Intangibles, including intellectual property, comprise a larger share of most enterprise’s total value than any of its tangible assets. How is an Intellectual Property Assessment conducted? In-house or outside intellectual property counsel must be engaged in each phase of the IPA in order to facilitate the process. Identify the purpose and goals.
