PARLEMENT EUROPEEN - Réponse à question E-003977-16 Direct supply of small quantities of foodstuffs to the final consumer. Annex XIV to Regulation (EC) No 1234/2007 on the common organisation of agricultural markets lays down that Member States are allowed to introduce exemptions for ungraded eggs sold to the final consumer on the farm or at market.
Under Article 1(2)(c) of Regulation (EC) No 852/2004 on the hygiene of foodstuffs, small quantities of primary products supplied directly by the producer to the final consumer or to local retail establishments are exempted from hygiene rules. In the ‘Guidance document on the implementation of certain provisions of Regulation (EC) No 852/2004’, the grounds on which the supply of small quantities of primary products to local restaurants is exempted are set out at point 3.3. This raises the question therefore of whether local restaurants are to be treated as final consumers and to what extent this principle applies also in the case of Regulation (EC) No 1234/2007.
