Le 5 novembre 2020, un tribunal de Californie a jugé que l’Agence étasunienne de l’Alimentation et des Médicaments (FDA) n’avait pas respecté la loi en rendant une évaluation incomplète des risques environnementaux liés à un saumon transgénique.
S’il a ordonné à la FDA de revoir sa copie, l’autorisation de commercialisation délivrée en 2015, et devenue effective en 2019, n’a pour autant pas été suspendue. Depuis le 9 mars 2019, l’entreprise Aquabounty a le droit d’élever en milieu confiné puis vendre son saumon transgénique aux États-Unis . Ce saumon a été modifié génétiquement par transgenèse pour avoir une croissance plus rapide. Si l’autorisation initiale avait été donnée en 2015, la FDA l’avait suspendue temporairement en 2016 suite à une mobilisation intense réclamant un étiquetage.
Le ministère étasunien à l’Agriculture (USDA) ayant adopté fin 2018 une loi controversée  mais permettant cet étiquetage, la FDA avait validé l’autorisation initiale en 2019.
