RISK ANALYSIS 18/05/16 Multi-Case Review of the Application of the Precautionary Principle in European Union Law and Case Law.
Abstract The precautionary principle was formulated to provide a basis for political action to protect the environment from potentially severe or irreversible harm in circumstances of scientific uncertainty that prevent a full risk or cost-benefit analysis.
It underpins environmental law in the European Union and has been extended to include public health and consumer safety. The aim of this study was to examine how the precautionary principle has been interpreted and subsequently applied in practice, whether these applications were consistent, and whether they followed the guidance from the Commission. A review of the literature was used to develop a framework for analysis, based on three attributes: severity of potential harm, standard of evidence (or degree of uncertainty), and nature of the regulatory action. This was used to examine 15 pieces of legislation or judicial decisions. The status of the precautionary principle within international law is still debated. 3.1. 3.2. 3.3. “Precaution does not necessarily mean a ban.
It simply urges that time and space be found to get things right.” Professor Andy Stirling, writing in the Guardian Overview The UK House of Commons Science and Technology Select Committee is carrying out an inquiry into genetically modified (GM) foods and the way in which these are regulated in Europe under the precautionary principle. STEPS Centre Co-Director Professor Andy Stirling gave oral evidence on 19 November following our written submission to the inquiry, which was signed by 19 academic experts in this area. The Centre has long-argued that a simplistic ‘pro’ or ‘anti’ stance on GM crops leaves little room for a more informed and balanced debate not only about this technology, but a range of alternative innovations too. The Transatlantic Trade and Investment Partnership (TTIP ) is allowing decision makers to put short term profits and growth ahead of long term goals of health and well-being of people and ecosystems.
TTIP is being used to iron out differences in regulations and rules between the US and EU, under the mantra of “the least trade restrictive rules work”, without due consideration of the public health, societal and environmental costs. Current work on legislation regarding Endocrine Disruptors (ED)1 and how this potentially will be undermined by TTIP is a prime example of how short term profits are being given priority over people and the environment. Endocrine Disrupting Chemicals are found or used in a range of products from plastics (e.g. Bisphenol A) used to store liquids and foods, and cosmetics, to pesticides such as Dithiocarbamates (Mancozeb), Iprodione and Thiabendazole. The current rules and regulations on Endocrine Disruptors (ED) in the EU have been at a standstill. Rev. Revista UNIABEU Belford Roxo V.4 Número 6 Jan. – Abr. 2011 Risk society and the principle of precaution: definition, purpose and the issue of imperativeness. WIKIPEDIA – Precautionary principle.
The precautionary principle or precautionary approach to risk management states that if an action or policy has a suspected risk of causing harm to the public or to the environment, in the absence of scientific consensus that the action or policy is not harmful, the burden of proof that it is not harmful falls on those taking an action.
The principle is used by policy makers to justify discretionary decisions in situations where there is the possibility of harm from making a certain decision (e.g. taking a particular course of action) when extensive scientific knowledge on the matter is lacking. The principle implies that there is a social responsibility to protect the public from exposure to harm, when scientific investigation has found a plausible risk. These protections can be relaxed only if further scientific findings emerge that provide sound evidence that no harm will result.
