L’affaire Google Book paraît au point mort, tant la machine judiciaire américaine semble s’être enlisée dans l’examen du second Règlement , qui devait mettre un terme aux poursuites dont Google faisait l’objet de la part des auteurs et éditeurs. Si ce n’était la parution d’une étude de fond par le professeur Pamela Samuelson “ The Google Book Settlement as Copyright Reform “, on pourrait penser que les choses sont redevenues complètement inertes sur ce front. Pourtant il se passe des choses, mais pour une fois, ce sont moins les livres sous droits qui posent problème à Google que les livres du domaine public.

Hier, sous le billet que j’avais consacré cette semaine aux livres du domaine public dans Google Book , un internaute nommé Pablo Iriarte a laissé un très intéressant commentaire , qui m’incite à revenir sur cette question dans un nouveau billet. Visiblement, les éditeurs ne sont pas les seuls à essayer de récupérer des ouvrages scannés par Google pour les réutiliser à leurs propres fins.The public domain, as we understand it, is the wealth of information that is free from the barriers to access or reuse usually associated with copyright protection, either because it is free from any copyright protection or because the right holders have decided to remove these barriers. It is the raw material from which new knowledge is derived and new cultural works are created. After decades of measures that have drastically reduced the public domain, typically by extending the terms of protection, it is time to strongly reaffirm how much our societies and economies rely on a vibrant and ever expanding public domain. The role of the public domain, in fact, already crucial in the past, it is even more important today, as the Internet and digital technologies enable us to access, use and re-distribute culture with an ease and a power unforeseeable even just a generation ago.

For years, I’ve regularly gotten requests from authors and publishers for licenses to reproduce images in books listed on The Online Books Page , or included in the local collection of A Celebration of Women Writers . Sometimes these requests relate to copyrighted books that I list but don’t control rights for; in those cases, I do my best to refer the request to the book’s copyright holder. But often, they’re for images in our own collections, from books published over 100 years ago."Captive Tomes" by traceyp3031 Historians know that our work is entirely dependent on access to and availability of sources, especially archival primary sources. Anyone who has spent months (and sometimes years) awaiting approval of a Freedom of Information Act request in Canada knows how frustrating limited access can be. It is a barrier to the free and open exchange of knowledge of our collective past.
