FHWA | Environmental Review Toolkit | Historic Preservation | Tribal Issues. Consulting with tribes in the 106 process may take many different forms and is most effective when based on ongoing relationships such as those facilitated by the unique Programmatic Agreement in North Dakota The Federal Highway Administration (FHWA) has a government-to-government relationship with Indian Tribes[1]. This special relationship is affirmed in treaties, Supreme Court decisions, and Executive Orders, and provides that FHWA and other Federal agencies consult with Tribes regarding policy and regulatory matters.

Section 106 of the National Historic Preservation Act (NHPA) also requires that FHWA consult with Tribes for undertakings that may affect properties considered to have traditional religious and cultural significance. This tribal issues page provides information on tribal consultation and coordination, examples of streamlining initiatives, and links to various resources related to Tribes and historic preservation. The Environmental Quarterly Volume 5, Issue 2 Spring 2009 LETTER FROM THE EDITOR Dear Environmental Colleague, Welcome to the Spring Edition of the Environmental Quarterly, the second for me as Editor-in-Chief.

As you might have guessed, I’m still trying to get my feet on the ground in my new position as the Environment Technical Services Team Manager and in living somewhere other than DC. Things are going very well. One of my goals is to figure out the best use of this space for future issues of the Newsletter. My goal and desire is be thought-provoking, provide some perspective and/or be entertaining in 130 words or less. Until next time, we hope you enjoy in this edition of the Environmental Quarterly and as always, if you have comments about a story or story ideas, please let us know. Sincerely, Lamar Smith Environment Technical Service Team Manager & Editor–in-Chief Phone: (720) 963-3210 E-mail: lamar.smith@dot.gov WHAT IS THE PURPOSE OF A REEVALUATION? By Stephanie M.
