European court decisions still accept in many cases the validity of the software patents granted by national patent offices and the European Patent Office (EPO) that is beyond democratic control. On 2005 the Commission appeared to be more supportive to the interests of major international conglomerates than of small and medium sized enterprises from Europe - who are a major driving force behind European innovation. Les négociations de ce traité demarré en 2006 ont été totalement opaques. Le débat démocratique a été éliminée et ouvre la voie à un processus législatif parallèle. Il transforme les entreprises d'Internet (fournisseurs d'accès, de service) en police privée du copyright, obligerait de facto par exemple, la plupart des plateformes de blog à fermer, l'expansion des medicaments generiques et acces aux soins aux habitants des pays les plus pauvres. Sous prétexte de lutter contre la contrefaçon des biens, ACTA est un dispositif répressif privilégiant les intérêts privés au détriment de l’intérêt public dans le monde.

The Administration has recognized previously the importance of protecting an open and innovative Internet in the context of our response to other petitions regarding the proposed Stop Online Piracy Act (SOPA) and the Protect IP Act (PIPA).
Since ACTA is quite different than SOPA and PIPA, we've decided to provide an ACTA-specific response. ACTA is an international trade agreement that establishes high standards for intellectual property enforcement.
